40 year rule for MOT exemption to come in 2018

  1. If it’s a big smash the police have a specialist team who will consider this - having an MOT does not currently exempt you from still ensuring your car is road worthy.

    If it’s a smaller crash then your friendly insurance asssor will assess.

    It’s the same as now. If you have an MOT then 3 month are later your tyres are balding and you have a smash the car is not roadworthy, MOT or not.

    So we are the ones who decides if our 40 year old vehicles are roadworthy or not ,so we just have to check our tyres, exhausts and check for rust etc etc and that’s it

    The police or VOSA if you get pulled or the insurance assessor if there is a claim and if the vehicle is damaged while laid up with its wheels off or engine out and the insurer has not been advised then the claim could be rejected.

    Over simplified but yes it’s the responsibility of the insured to ensure the vehicle is roadworthy.
