Arrest Warrant

  1. So last night the police turn up at my door with a warrant for my arrest. Happily I was on a train elsewhere so couldn't be carted off to the cells.

    The warrant was issued for an unreplied traffic offense - which went to my old address and was never received. The lovely rozzer explained he could clearly see why I have never received it (I rent my house out, we live elsewhere, and my V5 was only updated in September) and that he would try to have the warrant cancelled. He also hilariously advised that in the meantime should I be stopped by the police to give them someone else's name as otherwise (as an official Wanted Person!!!!!!!!!!) I would be immediately arrested.

    He phoned me back today and has been unable to get the warrant calncelled, which even he concedes is utterly ridiculous - I am a 38 year old middle-class woman with no criminal tendencies!!

    He advised that I had to go to the station, be arrested and put in the cells and then transported by the police to the Magistrates Court. At this point I'm in floods of tears with visions of handcuffs and hellish cells.

    Happily he felt so sorry for me that he got his Inspector to agree that I could instead present directly at court and be arrested there instead (you know it's a bad day when the only bonus is WHERE you're arrested and not that you're NOT being arrested!!!!!)

    So now I have to go to court on Friday morning for charges on a speeding notice I've never received and Failure To Provide Details that I've never actually been asked for.

    And to top it off, the speeding notice is entirely weird as it's not date specific - it states the location and then says between 17 April and 25 May 2012. WTF???????

    The police said just to use the duty solicitor at the court as the circumstances are cut and dried.

    Found it quite amusing yesterday, today I am flipping between fury and misery. Sodding country should spend time arresting proper criminals (and yes, clearly I know now I should have updated my log book sooner)

    All advice greatly received (including changing my name and leaving the country)

  2. Someone probably cloned your plates and went on a speeding fest. Without an exact date/time/photo then surley thats insufficient evidence?

    pm baydreams he knows' something about speeding fines and how to get off them - least i think it was baydreams ?
     
  5. That makes no sense, if they can't even say when the offence was committed ... maybe the solicitor can advise on that. Otherwise, though the idea of being on the run sounds exciting, I think I'm with Bern - go to court, get it over and done with (I'm sure it'll be less stressful in the long run). :(

  10. Present yourself at a modern police station the night before, you'll get free food, and good nights sleep and if you pick the right day maybe some peace and quiet :)

    I would deffo query the offence though, there's a lot of no. plate cloning going on, or have you had your no. plates stolen recently or in last year or so and forgot to report it?
     
  11. Strange. So were you supposedly caught by a speed camera or a mobile unit with a speed gun? Where is their evidence?

    my advice..... RUN FOR THE HILLS! DON'T LET THEM TAKE YOU ALIVE!!!!!! O0

    (or, nip to see your own solicitor tomorrow for some proper advice).

If you are to appear at court on Friday - can you not formally declare under oath that the fine was sent to an old address and request that the documents are reissued to you at the correct address with the supporting evidence. This will give you time to review these and to either admit to committing the offence and therefore pay the fine and take the points or to question the evidence. They must get these all the time - i can't believe you would end up with a criminal record for not living where the letter was sent.

    My guess is a decent solicitor will have this laughed out before it gets there that is why i am joking about it , Zoe , go to a solicitor don't rely on the duty one to sort it !
