When you try and be nice

    Had an incident last week where I was approaching an island. Lady in the left hand lane decided she wanted to come in to my lane without indicating. The cars came together, her's being a brand new BMW. We both got out, straight away she got on the defensive saying that I came into her lane. I was quick to point out that I was in my lane the whole time and she crossed into me. Moving on, I then looked at the damage, and I managed to rub the marks off her rear quarter and amazingly there wasn't a mark left. The alloy wheel had a couple of marks and being diamond cut I said that she would possibly need a full refurb.
    My car was a bit worse off with some scratches and marks but being 12 years old, and the fact she was young I said I would sort the damage so not to increase her insurance.
    Misses got a call yesterday to say she was making a claim against me for crossing into her lane.
    Obviously didn't realize I had a dash cam :)

    Do you have a certain time to report an accident to the 5-0?

    I’ve been hit twice in the last 5 or so years. Both times they’ve got out of their cars gobbing off. Both times I’ve mentioned my dashcam (which I haven’t got). Both times their insurers have contacted my insurer to admit liability.

  5. Wife got tee boned by a woman driving off a car park into the side of her. Cut and dried you would think! Took almost 3 years to get sorted with the insurance company! She denied being there, then it wasn’t her fault, etc etc… some people have absolutely no sense of morality whatsoever, no compassion, no remorse and no empathy. This selfishness bordering on psychopathy of the way people approach their lives and their relationship with others has become so commonplace with the entitled I wonder if it might become the absolute norm. I do hope not!!

    I hope you get it sorted but it will certainly colour your approach in future. I note you’ve a dash cam so possibly a wise precaution (or you’ve been caught out previously). I’m guessing insurance companies don’t even flinch at false claims if it makes no difference to their own costs. Should be a criminal offence. If I were you I would let plod know about the incident!

    If there are no injuries to people other than the drivers ,or damage caused to properly other than the vehicles involved then no need to report . Also if the above conditions apply and police attend then they would just ensure details are exchanged and no rtc report would be recorded . . I would advise that at any accident ,to always exchange details to prevent a claim of failing to stop which is an offence seperate to any other matter relating to the collision
    "Accidents " have ben called " collisions " for some years now after a very clever expensive barrister sucessfuly defended an " accident" as an act that by nature is an unavoidable incident , an accident!!!!!.

    I would say that an accident is a non intended incident, rather than an unavoidable one.
     
  8. Good luck with that - but your dash cam should prove conclusive. I have had one fitted for 3 years now - no accidents/collisions yet but feel a bit more protected against false claims. Everyone should fit one.

  9. That's why they are referred to as Road Traffic Collisions nowadays, instead of Road Traffic Accidents.

    Some insurers also require you to report any incident to them (mine requires it within 24 hours) so something to check @Sproggy4830 ?

    That’s what I was thinking. It’s the insurance company who want it reported once a claim is received

    It's pretty conclusive on the dash cam. 100% she's in the wrong. She will be paying for my damage now and the cost of a hire car for how ever long it's in the body shop being fixed.

    That’s what happened to me. I was quite happy about it as they deducted £500 I kept the car and spent £45 on a new headlight and all was good. I’m not fussed about the scratches.

  14. Trouble is, half the time, the insurance companies just go 50/50 to make things simple.

    Yes lane changing is normally 50/50 unless you have evidence to suggest who's at fault.
     
  16. You should call your insurers to inform them of the incident. Give as many details as you can of the incident. Mention the damage to your vehicle however slight. They will call you for more details and pics of your car damage. It would be worth you preparing a diagram or street view of the location showing lanes etc as your insurers will need to know exactly where the incident occurred and any road markings or signage.

    Re the other driver saying it was your fault, I would not get uptight about that, after all you know what actually happened and your dashcam may confirm your side.

    A few years back I was in a traffic queue when these 2 boy racers drove into the back of me. They told their insurers it was my fault and they tried to claim for whiplash injuries.

    Your insurer will send a you a copy of the other driver's statement and vice versa.

  19. My mate got a call from his insurance company to say that a lady in the village where he lives was claiming that he had hit her car in his works transit van. She was claiming that there was damage all down the side of her vehicle. Now my mate keeps his van spotless, and he said straight away to his insurer, you tell me where one of your approved garages is within an hour of where I am and I will take it straight there right now and prove to you there’s not a mark on it. Then it turned out the day she claimed he’d hit her, he wasn’t even working in the village. His insurer told him to forget it, he said she’s clearly trying it on and it’s clearly a bogus claim, he said between me and you it happens all the time with sign written vans.

    The MD of a company I used to work for wangled out of a bunch of parking tickets by claiming he'd leant me his big Merc! Like he ever would! I had the cops chasing ME for the money and when I explained the situation after having to travel right across Bristol to see them, they refused to prosecute him. I was livid TBH, their attitude in letting him off but being happy to harass me says it all.
