Camping in your bus and drink driving

  1. the law is pretty clear - its up to whether people want to chance it. Private land, no issue, public highway, against the law.

  3. I can't remember fully but there is a something like The Sheldrake ( or similar) and it is called upon in courts to prove that the driver had no intention of driving. My friend who is a policeman mentioned it last year.

    On the odd occasion where I have slept in my bus after a night out I always remove the rotor arm before I leave the bus for the night and throw as much stuff on the drivers seat so it looks like you can't use the vehicle even if you wanted to.

Have had long discussions with police officers in a previous job, with the conclusion of it depends how extreme the officers want to take it, the thing they advised most of all is not to have the keys in your possession and as others have said show that you have no intentions of driving with blinds etc up. Notice that someone mentioned about folk driving home on the sunday after a show, have often commented that most people are probably still over the limit, and it is a big risk that you take personally, its common sense at the end of the day as a lot have already said!

    When asleep in your camper with keys in your pocket drunk is it drink driving or drink sleeping?

  8. All this stuff about "if you're drunk and have the keys In your pocket you are technically drunk in charge of a vehicle" is utter parp

    If this were the case then if you were drunk In your own home or a pub with your car keys in your pocket then you could be prosecuted for drunk in charge of a vehicle.

  10. im tea total for over 20 years so it dont matter to me, i do have a laugh when i do get pulled up & ask for a breath test haha. But as for sat nite then drive home sunday a vw dos thats what show n shines for, getting up way to early, u sweat your arse off cleaning the van, u have to drink loads of water + redbull to talk to peaple time its finished u at 4pm u are no longer drunk just full of caffene & bouncing of the walls haha >:D

  14. Have often wondered why they just don't do breath operated demobilizers, that wont operate if over limit, would save alot of wasted police and courts time??? :thinking: Dragons den anyone?

There was a guy on the same rehabilitation course as me when I was done for DD a few years ago who was nicked for drunk in charge when he went out to the hotel car park where he was staying to retrieve his laptop from the boot. He must have given the copper some lip or the cop was just having a bad day. The fact that all his stuff was still in his hotel room and he had no intention of driving made no difference.
    If the private land has public access you can still be done on it, car parks are a prime example. I would not be comfortable sleeping in a tesco carpark while over the limit in case anyone asks me to move on, or if an over ambitious copper decides to ruin my day.
    Better off having a scout round the area in advance and approach local farmers etc to find a suitable spot

    I have a bit to add to this. Some years back my brother was very drunk at a 30th Birthday at his local. He went to fetch the cake and candles from the back seat of his car and was approached by 2 police officers whilst doing so. They asked his intentions etc and my brother pointed out that he was completely boxed in and was just fetching the cake. Some sarcasm and lip followed, so they decided they would breathalyse him. He refused the test and was promply arrested, this did not go down well and the incident finally involved about 20 officers, 4 vans and 2 cars but still only 1 arrest.

    He was later banned from driving for failing to provide a specimen. This is considered as bad as drunk driving to the courts, insurers and employers. He had no legal argument for not taking the test.

    The correct action was to provided the specimen and then argue about intent to drive when you get to court. He gave up this option by not taking the test.
