Ebay rules and regs

  1. I sold a pair of bay seats on ebay on the 3rd November for £240. Buyer paid on 6th nov.

I stated in several emails and one phone call that I needed them collected ASAP and out the way...

It's now the 30th and they are still not collected.

Am I right in thinking that if they are not collected in a certain amount of time I can get shot of them elsewhere? I remember reading it somewhere that they have 30 days to collect, if not you can re-sell. But I've looked through the ebay rules and can't find anything on the subject.

Any one else had this problem?

  4. Under the sale of goods protocol, unless you stated categorically that the buyer must collect by a specified date, 'As soon as possible' can be interpreted by the buyer to mean when it's possible for them....
You'd usually be advised to contact the buyer (by email, text, whatever) and say that s/he has seven days from receipt of this message in which to respond with a mutually agreeable arrangement, otherwise the sale is null and void...Ebay may have slightly different rules, but as far as consumer protection is concerned, it all hangs on the idea of what is 'reasonable'....

Good luck with it....some folk can be an arse to deal with

  5. Also...if he paid you directly via Paypal, you may want to notify them...

  6. Yeah I never stated that I wanted it picked up ASAP, but when the auction finished I emailed saying I needed it picked up by the end of the next week, then a few more similar emails. Then a phone all and said I don't have the room for them and need rid of.
    Still nothing.

So your saying.. Email him with 7 days to collect. The. If nothing.. I can get shot of them? Also email paypal to say what's happenng..

It's not that he's an arse.. It's just weird that he's paid £240 and seems to have no interest in collecting what he's bought? It's weird lol

  7. So you've actually given the seller ample opportunity to sort something out in that case. Think @rickyrooo1 mentioned that the buyer may have certain rights to reclaim their money...doesn't seem fair, particularly when you've upheld your side of the transaction. Maybe Fleabay grievance is your only recourse....

  8. Could be some mitigating circumstances....? illness, death of a family member...you never know? Chances are he's just not managed to get his sh*t together....doesn't help your situation though

  9. That is not really fair especially if he is out of the country or having problems..

    why the rush?

  11. Well I just haven't got much space in my house, only stuck them on ebay for a quick sale. Every time I've spoken to him he just said he's too busy at work, but if you have enough time to email me through ebay, you have enough time to arrange a courier online. ?

  12. 2 weeks is considered 'reasonable'....and while I agree LEF, if the buyer didn't respond at the time, categorically stating that collection 'by the end of next week' would be problematic, then that's near as damn it entering into to a verbal contract

  13. fair enough...

  14. looking at it totally impartially....Person A advertizes goods for sale thru Ebay, person B wins the auction and pays for them. A contacts B to arrange collection. B agrees to a specified arrangement at the time of conversation.....B reneges on the arrangement.....

I had a similar issue with a bike I sold on ebay, but the buyer was very pro-active in contacting me to let me know where he was up to...which makes all the difference in how you react

  15. I know, I should have stated need collected ASAP. I just emailed again saying "any luck with a courier" and got an email back after 5 mins saying "really busy with work, will sort soon thanks"

    Lol.

  17. Think you need to be a bit more assertive. Tell him that you will have to store the seats outside, undercover, as your relative's staying over for Christmas and you are now decorating the box room...then put the seats outside undercover.
