There's a subtle yet significant difference between giving an opinion on something and asserting fact. If you buy a kettle and say that it's not very good at heating water, that's not the same as stating that you believe it was knowingly and deliberately made that way and sold under false pretences. If you have never actually bought said kettle, in fact you've never seen or used it, but are asserting that the manufacturer still knowingly made it badly simply because someone else said so then yes, you can find yourself in trouble if the manufacturer can prove you did damage to them, maybe in terms is sales for example. My view still stands. Safe ground is where this 'clear cut' case, which is what you guys are saying when you want to name and shame is, is taken to court and proven, then you can give an opinion on a legal judgement, and rightfully so. But let's say it goes to court and the court finds the garage not guilty. Or that other dealings not clear here come to light. How do we withdraw the name and shame? How protected do you think you as a person would be if the garage sought to seek damaged against you? £100k for smiley facing Lord McAlpine trending on Twitter? The Internet is a million litigation cases waiting to happen.

Just re-read my posts - I sound a lot angrier than I remotely actually am - so apologies for that - I tend to write a particular way is all (yes, sat down using hands on keyboard before someone posts smart arse reply!) The thing I notice is that ALL trades have talented individuals and shysters - I don't think there ever was a day when you could pay someone to do something and be guaranteed each and every time that it would be up to scratch - however, when you find a person or company that gave you value for money you should stay loyal - the garage trade however is a necessity and there is always another mug behind you when you speak with your feet. Maybe the solution is those 'recommended' websites rather than a coconut shy.
Hi @Moons, yes I read your angry posts but took with the required pinch of salt. You're sort of right, but at the end of the day it's none of your business how the owner chooses to procede and none of mine. I can only describe what I see wrong and then the balls in her court and none of us have any right to prod her in one direction or another now matter how we feel about it. The bus? I'm quite quick and I put the panels in the right place which saves a lot of the mucking about with filler! The rear end/arch is now complete and filled - I do a bit when I'm passing it by. The inner arch is repaired and attached to the closing panels to keep the water out. Over to the other side next, then on to the rusty areas that have been ignored. Bottom half should be sorted before too long/too much money is spent.
So you happily let others fall into the same situations because its "nothing to do with you." Nice. If I have poor work done on my bus, I'll be sure to name them so others can avoid. It'll all be done in my opinion and at least others will then be free to make up their own minds.
I think the situation in this case (all cases) would require the owner to seek redress from the business in the first instance, giving them the opportunity to put things right, perhaps if needed with the threat of court action and name muddying. If that failed then actually take them to court. As said above, if they won, then slag away on the forums, but as a business myself, I would be upset if somebody jumped straight to the forum slagging stage. Whatever our feelings I believe that's how consumer law operates.

I'm surprised Zed as i thought you would want some protection when undertakinga lengthy restoration job? 'In writing' doesn't mean a letter, an agreement by text or email is clear. Obviously things get uncovered as paint and old metal is cut away and I'm not talking about nailing someone to the floor and riding roughshod over them trying to run their business. But only work we have agreed will be done. If he uncovers something and sends a pic to say this chassis member needs Replacing at £x so be it. We'll agree a price. It's to cover him as well as me, and as I trust him as a supplier he also trusts me to pay for the work we've agreed. It's a local guy, I wouldn't dream of trying to manage something like this remotely. I'm a business man, as in all business transactions if someone refuses to accept an agreement or underline the quality of their work I'd walk away anyway. Clearly a lot comes down to reputation too. I know a guy who bought a passat a couple of years ago and took it in for service. He didn't get an agreement of what that service should entail, he just asked for a full service from a small local garage, whatever was needed. When he got it back and it had had a cambelt change and various other things changed, all parts available to inspect, he had a bill of £800+. He ranted and raved, slagged the garage off to anyone who would listen. A lot of people listened and the garage became branded as a rogue. He wasn't, he did what was asked off him but then the actions of one person sullied his reputation.
